WARDEN'S COURT.

(Before W. L. Simpson, Esq., Warden.) Monday, Oct. 10.

Cowap v. Carrand Willis. — Mr. M'Coy appeared for plaintiff, and Mr. Gooday for defendants. Plaintiff charged defendants with being in illegal occupation of a claim, his property. It appeared that in November 1868 the plaintiff held a water-race about two miles below the Beaumont. He sold the race to the defendants on the following conditions :—: — To pay £20 down, give £30 worth of labour on hi 3 farm, and pay £100 in twelve monthly instalments. The two first items were paid, but no part of the £100 was paid. Although he had often asked them to pay they would not do so. They offered to pay the money yesterday, but he would not take it - he wanted repossession of the race. Mr. Gooday stated that his clients were prepared to pay the money within half an hour. Verdict for defendants The Warden suggested that they should now settle the accounts amicably between themselves.
