(Before W. L. Simpson, Esq., R.M., and Alex. Stewart, Esq., J.P. Monday, 14th March, 1870. .Hay v. Mears. — Claim of £17 18s., for goods sold at auction The defendant paid £14 4s. 6d . into Court, and pleaded not further indebted. It appeared that the goods for which the balance was claimed had never been delivered. Th^is was proved, and judgment was given for plaintifff or the amount paid into Court only, the plaintiff to pay posts. Hay v. Fyffe.— Claim of £8 35.. lOd. Settled out of Court. Kellar v. Collins.— Claim of £5 10s. 3d. Settled out of Court. Smith v. Choo Qui. Claim of £17 18s. Debt admitted. Defendant asked for time, half the amount being paid at once. Their Worships gave defendant one mouth in which to pay the balance. Tuesday, 15th Mabcb. (Before W. L. Simpson, Esq., R.M.) Meads and Brown v. Campbell. His Worship now gave judgment in this Qase. He said that the management of all main roads was in the hands of the General Road Board, which body had power to close a road upon giving some sixty days' notice, but not otherwise: The general supervision of the road, doubtless, rested with the Superintendent, but in this case the Secretary for Lands and Works, who was not even an officer of the General Road Board, had attempted to close this road, and without any authority to do so. That the plaintiffs had sustained damage, he was satisfied, but they had no remedy against the public, because the road was a public one, and was still o.pen. Possibly the contractors might have some claim on the Government, but of that he was not aware, as the specification had not been produced, and it was moreover irrelevant, to the case. Case dismissed, with costf.
