Kepple v. Herbert.— Claim £32 for damage alleged to have been done to two horses, the property of the plaintiff, which he had some time since lent to the defendant's servant. Mr. Mouat (from Mr. M'Kea's office) appeared for plaintiff, and Mr. »). F. Herbert in person.
The defendant pleaded not indebted. After hearing evidence, his Honour desired that parties should endeavour to settle this case without his giving judgment, and an attempt was made to do this, bxtt it failed, Mr, Herbert complained that no notice hid ever been given to him that Mr. Kepple had any claim upon him \ till he received the summons. f
His Honour said that Mr. Herbert's complaint was not without foundation. He could not give large damages, but they must be to some extent substantial. Verdict for plaintiff. Damages £13; costs to be divided.
