WARDEN'S C'tiUET 1 .

(Before W. L. Simpson, Esq., Warden).

The application of E. Vernon: for two acres of ground for mining purposes, a dam and tail race, came on for hearing. Mr; Herbert appeared

as agent for the provisional trustee in Charles Anderson's sequestrated estate, to 'Oppose. He objected to the applicant getting a certificate on the ground that the area applied for embraced, the claim owned by Vernon and Anderson, and. over which Anderson gave a ( mortgage for £125 ; also, that Anderson still had a share hi said area or claim. Evidence was adduced on both sides, however, of a very unsatisfactory kind, the memory of some of the ; witnesses being apparently very defective. The Warden remarked that he would not grant a certificate for the claim until tho litigation commenced in the Supreme Court relative to Anderson's matters was concluded ; neither would he grant a certificate for the dam on the, same principle. Aa to the tail race, it would naturally follow the fate of the claim.

Judgments were delivered in the "following adjourned cases :—: —

Police v. Grriffen. — For carrying on business without having a business license. Fined 55., and costs.

M'Kay (Chairman of the Board of Wardens) v. Hogg and Eae. — For allowing sheep to stray on ground set apart for great cattle. Ordered to remove sheep, and to pay £1 and costs of Court.
