WARDEN'S COURT.
(Before W. L. Simpson, Esq., Warden.) ■ Thursday, February 12. • Quirk t. Best. — Claim, £100, for loss and damage sustained through non-fulfillment of agreement. In this case it appeared that ' plaintiff had purchased of Best four one-seven-teenth shares in the claim known as the British America, Blue Spur, a memorandum having been given by Best that he had sold the claim for £115, on which 10s. was paid by way of deposit, the balance to be paid within one week. The evidence having been beard, verdict was given as follows : — Quirk to receive back his deposit and to be paid expenses. Mackay. t. Poison. — Plaintiff charged defendant with depasturing sheep on the goldfields without license so to do. After hearing the evidence, plaintiff was nonsuited. Docheety T. Spillan . — Claim, £8 10s., for trespass and damage on an agricultural area held by plaintiff on Tuapeka Plat. Mr. Keen for plaintiff, and Mr. Mouat for defendant. This case was brought on in the Resident Magistrate's Court, but exception being taken by Mr. Mouat to the jurisdiction of the Court, the matter was by consent brought into the Warden's Court. Verdict for plaintiff, £2 damages and costs*
