BouGiijjsr -v. MG-ill. — rClaim, £16 18s. 9d., for ballance of account for wheat. £8 paid into Court,, and ]Aed not indebted. The evidence of plaintiff went to prove that the wheat was sold at. 6a. 6d. per bushel .per sample. The evidence, went to prove that the stock was not the same as sample, and that the cleaning of said wheat and los& would amount to from twenty to twenty-five per cent. The sample was not produced.' It was allowed by defence that the price of wheat was payable only upon his getting delivery at ! the mill, Tokomairiro, and weighed. In this case the wheat had not reached the mill ; but the defendant admitted that sufficient time had elapsed since the purchase to have the wheat at Tokomairiro, same being stored in Lawrence for three months, or since September. The Magistrate said tho sample ought to- have been produced. Finally, verdict was given- for amount, with costs. The Magistrate stated that execution, should not be issued until the wheat was weighed, which must be done forthwith.
