M'Phebson. — Claim, £20, for damages sustained in consequence of two head of cattle bought by plaintiff at Waitahuna, in June last, not having been delivered. After several witnesses had been examined, his Worship said that his difficulty was as to whether the cattle had really been knocked down. He did not think there was sufficient evidence of a sale in the cats. As to the sale note, he placed no value upon it, as the auctioneer's agency in any sale ceased with the fall of the hammer. Mr. Keen, on behalf of the plaintiff, asked for an adjournment for a fortnight, which was granted.
