Fined 15s. and i costs of Court, or twenty-four hours' imprisonment. Clark v. Speedy. — Claim Lll 153., being amount of bill of exchange. No appearance of defendant. Verdict for ■■ plaintiff in amount claimed and costs of Court, in default of payment and dis- : tress, one month's imprisonment. Cranley v. Speedy. — Settled out of Court. Walsh v. Clark.— Settled out of Court. Thursday, Augut 27Bowes v. Malane.—^Boweß charged Malone with having, on the 21st inst., at Wetherstones, struck him on the mouth with an iron bar, and afterwards with his fists, and also with threatening his life The defendant pled guilty under great j provocation. .Thomas Mulligan being sworn, deposed : I know plaintiff and defendant. On Friday, 21st inst., I saw Malone strike Bowes with an iron drill some fo'ir or five feet long. Bowes did not give him any provocation. There were a few words about some picks. Malone commenced to call Bowes names, such as thief, rogue, &c. After the defendant struck with the bar of iron he then struck him with his fists in the face, and also threatened to take his life. There was no bad feeling between them as far as I know. I am a mate of theirs in the claim. Bowes did make a complaint that th,e defendant did not do his share of the work. . Cross-examined — He (Bowes) did not abuse you before you struck him. He never said that that was, all he wanted. Sometimes you /worked well, and at other times you did not. Bowes complained that you took two hours to your dinner. Not to me, however, but in M'Luskey's store. I did not hear him. I never heard Bowes say that he would put you out of the claim. We have never tried to, put you out of the claim. Yoii and Bowes are not the best of friends lately. You • did net work like the rest.
