The English Mail via Panama closes at the Post Office, Lawrence, on Monday, the 3rd instant, at eight o'clook p.m. ; and the mail via Suez doses or. the evening of Thursday, the 6th instant, at the same hour. Oub Tokomairiro correspondent informs n» that a very serious accident took place in the Tokomairiro Bush, on Tuesday evening last: Mr. Dawson and his son were felling a tree, and it was prevented falling to the ground as another large tree stood in its way, and consequently supported the falling tree, causing Mr. 2>awßon to fall the second tree, when the crash of both trees falling to the ground Mr. Dawson was unable to get clear, one of the trees falling right across his body, causing the sawyers to cut the tree through to enable them to release the unfortunate sufferer. After removing the tree he just spoke, and lingered about a quarter of an hour. He has left a widow and large family to lament his untimely end ; he was a man universally respected by those who had dealings with him — indeed, all who are acacquainted with the widow and family, cannot speak in terms adequate enough to convey to the public the untiring perseverance of their past conduct. The following is the judgment in this case, as given by Mr. Warden Croker on Monday, July 27th, 1868 :— ln this case complainants object to the defendant's application to deolare abandoned the road leading along the Blue Spur, passing through :— Rich's Gold Mining Lease ApplicaI tion, Great Extended Lease (from which it has been deducted), Spier's and Co.'s Lease (from which it has been deducted), M'Neilly's through the S.E. coraei. and included ia Lease, Fenton and Morrisons Lease (from which it has been deducted), Mouat's Lease (from which it has been deducted). There are four classes who claim that their interests would be prejudicially interfered with by such an arraugeinent :— l. Water race holders ; 2. Residence area holders adjoining ; 3. Claim holders ; 4. Persons passing to and from their claims. The first because, by the abandoning of the road, the races would bo cut oii" from the claims. The objection is not valid, because tho road line it may be said, is in all cases deducted from th.c leases, so that those who now hold water rights along it must he protested agaiuai all comers as prior holders ; as also those whose raoes are clear of leases and. other righta. The rights of those, which pasa over the S.ti. angle of Fyfo's claim (a small patch) which has uot been deducted, will depend prob^biy ou priority or other consideration. Residence area holders have placed themselves iv tUe uositiun they occupy for temporary convenience, and with a fair knowledge of surrounding circumstances, and so I think they must take tho consequences, moving at their own expense, when they lind theii* position no longer tenable. Claim holders have a right to a road way wit hia a reasonable distance from their claims which they will have at other poiuts, notwithstanding that the original line be worked out so that objection is disposed of. As regards those who claim a road passing from their claims-.to their residences, and vice versa, I think it is unreasonable. Sufficient tracks will, no doubt, be found as old onea become impassable. Vnder these circumstances, and in face of the fact that the road line is auriferous, and that its being worked away is otherwise necessary in, and to the present interests, the order of the Court is, that it be considered abandoned from this date. The penalties directed in cases of inter* ferenoe with this road line are not to be levied, provided that costs as ordered be paid. An adjourned meeting of the Lawrence Town Council was held in the Council Chambers on \ Monday evening. Crs. present — ltobertson, j Dcmvan, and Jeffery. Horace Bastings, Esq., Mayor, presided, and in a short address to the retiring Councillors congratulated them upon the amicable way in which they had performed their duties iv connection with the Council, ] and trusted the new Council would work equally harmoniously together. Mr. Meyer j having made the necessary declaration, took his seat as Cr. for East Ward. Cr. Jeffery I then proposed, and Cr. Donovan seconded, j " That Cr. Middle Ward." j Tbb usual monthly meeting of the Committee of the Tuapoka Hospital' was held in the ■ surgeon's residence on Tuesday evening, th» ' 28th ultimo. Present- Dr. Halley (in tke chair). Messrs. Potts, Smith, Hay, Henderson, Meyer, Farrar, Russell, Hayes, M'Swiney, and Dr. Stewart. The minutes having been read, the following resolution was passed : — " That the Secretary write to the Government, asking whether the money placed on the estimates for the erection of a brick ward for refractory patients, will be placed to the credit of the. Committee." Mr. C. H. Russell was appointed one of the Visiting Committee in place of Mr. Potts retired by rotation. A conversation then followed as to the best means of providing the Hospital with wholesome water. Mr. Russell gave notice that he would move a resolution, " That a brick tank, suitable to the requirements of the Hospital, be built in grounds of the Hospital." Major Croker declared the old roadway abandoned on Monday last, and Morris and Co. havo resumed work in their claim at the Lawrence end of the Spur. The Great Extended Co. are washing away the shallow ground at the foot of their claim near the old workings of Creswick ani Co. The Petaeveanee Co. have succeeded at last in making their dam watertight; and they are now sluicing away the upper portion .of their ground near the old road line. The ground in which they are working is very rich, and they are obtaining from twelve to twenty-six ounces of gold weekly from their boxes. The heavy landslips hare greatly damaged the toil-races of j Keppoi and Co. and the Perseverance Co. , and j a large quantity of the Perseverance Co. 1 * j ground has settled down into the workings of ! Keppel and Co. The landslip* aro causing, and i are likely to cause, much litigation.
