Fbidat, sih Junb. Howitt v. Hughes. — Mr. Keen for plain-. tiff, " Mr. Riohards for defendant. In this, case the plaintiff endeavored to compel defendant to fulfil an arrangement said to havebeen entered into by him some time ago : — viz., that defendant sold to plaintiff a sharein a mining claim at Tuapeka Mouth for £5. This defendant denied, and stated as his. reasons that he was not at liberty to sell, as. •fcheshare belonged to one Geddes, who is now undergoing a sentence in Dunedin, said Q-eddes having bought the share for £25, andpaid thereon the sum of £20. Defendant recollected .having some conversation about the share with Howitt, and he recollected also that he said on the occasion that he could not entertain any. offer in reference to. the share until be saw the Warden ; h« stated also that he had not seen the Warden in, reference to the matter. Case was adjourned until Monday, the Bth ujt, for judgment.. La giving his verdict the Magistrate said that it was evident from the evidence that Mr,. Hughes had offered to sell, and Mr. Howitt had accepted, but that the contract never had been completed. He must therefore give theverdict for defendant with £wo guinea* ex* penses, and costs of Court.
