In the Police Court this morning, before H. 0. Lawlor andß. T. Douglns, Eeqi, J.'sP., Patrick Murphy, alias Kayanagh, was charged with stealing a swag, of the value oj £4/ 10s, the property of Henry Ibboteon, from the Wharf Hotel, on Friday evening last. Henry Ibbots. n deposed that on Friday last he left a swag at th. Wharf Hotel, and that aocuaed called ond asked for it, taking it away without his authority. Seccombe, landlord of the Hotel, deposed that Ibho'aon called and left a Ewag at hia Hotel on Friday evening ; but later on accused called and said the little blacksmith had sent biaa down for the swag. Witness asked him to leave his name, but he took away the swag without doing so.—A barmaid employed in the Hotel gave similar evidence.—Detective Doolan gave evidence to the effect tliafc Ibbotbod reported to him the loss of the awag, and he subsequently arrested the accused, who after his arrest stated. Ibbotgon had sent him for the swag, and be had brought it and given it to the prosecutor, in the presence of P. darken.—Accused made a statement to the effect that he was with the two darkens on Friday night, when Ibbotson met them, and they went to Vaugban's Hotel and had a drink. While.there, Ibboteon said he had lost his swag, aud Murphy told him where it was, saying that he would get it for him. They afterwards took Ibbotson to his hut, and Clarken went home, while witness went to tbe Wbarf Hotel and got the swag, and on bis way to proseoutor's house, met Ibbotson in Albert street going f:r it, when he gave it to him and left him.—After hearing the evidenca I of Sergt. McGrath, the Bench said that as the e»idence was somewhat conflicting, they would give accused the benefit of the doubt, and he would therefore be discharged.
