WARDEN'S COURT.

THIS DAY,

(Before H..Keniick, Esq., Warden ) W. S. GREENVILLE V. E. K. EDWABDS. This was a clafm'for one»half share (or its market valueVTn the Hibernia licensed "holding, now the Darwin G.M.Co., which plaintiff alleged had been promised to him by defendant, in consideration for his services in helping to dispose of the promo ters,' shares.

Mi Miller appeared for the plaintiff, and Mr Lush for the defendant.

W. S. Grfenville, sworn, deposed: that an arrangement had been come to between defendant and Col. JBVasjer and himself, to the effect that if he (plaintiff) assisted them to dispose of the shares in the Hibernia Licensed Holding, they would each give him a half-share as bis recompense. He went to considerable trouble in this matter, though his efforts were unsuccessful. De«. fendant on one occasion when going to Auckland to float the Darwin Company, promised to see that witness' share was se- ! cured to him. When gold*was struck in the claim defendant also said to witness that his shares were all right, and he could sell them if he wished, but afterwards sai i witness had better wait till he wrote to the legal manager about it. Witness afterwards found that his name was pot on the register. He told Edwards of this, and he said a half share had been given to Comer, who would have to divide it with plaintiff. Tho ;half shpre he claimed represented 200 shares, which he could have sold f0r,10,3 6d each* H. T. Rowe deposed that he-had not succeeded in floating the, Darwin Co., and saw Mr Edwards in Auckland when there was no prospect of the company floating, and it was put into F. A. White's hands. Edwards proposed that the thing should be given into/the hands of Mr McDonald Scott, and this was done. ' Edwards stated then that witness and Grpenville should have half a share each for their trouble.

Robt. Comer swore that he had obtained 200 shares—equal to half a share —in the Darwin Company under an arrangement made with Messrs McDonald Scott and Edwards ; these were given to him for assisting; to float the, company, Other persons received half shares for assisting to float the company. Michael Hennelly, sharebroker, said he was present at a conversation betweea the plaintiff and defendant lecently, when Mr Edwards said he had left a ihare with Mr Scott, the legal manager- of the; Dawint Co., to be divided bejiireen the plaintiff and Mr Comer; Mr Greenville authorised witness to wire fc) Mr Scott, which had been done.

Wm. Laurie corroborated the evidence of the last witness.

This closed the case for the plaintiff, and Mr Lush sdd that the defence was that no such contract as that alleged had been made. : [Left sitting.]
