AUCKLAND.

This day.

Richard Pains, an old settler at Raglan, died suddenly yesterday through bursting a blood vessel. * In the appeal case, Barty v. Slight, heard in the Supreme Court yesterday, His Honor Judge Gillies said that the proof of consumption was not "conclusive" evidence of sale to the drunken man. This was a very natural misunderstanding of the effect of the word "evidence." He would allow the appeal, and quash the conviction. Mr J. M. Alexander appeared for the appellant.

, The Blue Bibbon Army have leased the Theatre I Royal for one month, during which time great efforts will be made to spread the cause.
