In the Magistrate's Court, Dunedin, yesterday, Louis Lonlscha, tho conductor oi the Tambour-Major Company, sued Howard Vernon, the lessee and director, for £15 salary. The defence was that the company, since McCallum'e insolvency, bad been carried on as a 1 commonwealth ; nnd as hnjinesghsd not been-good the member* cou'd not be paid full salaries. The plaintiff swore there w.ni a speifsl agreement, > ar> far an he was cooevrned, but thi-» was denied by Vernon. The Magistrate, in nonsuiting the plaintiff, said it was clear from the evidence that defendant had to pay salaries only out of

earnings to members of the company, and there was no evidence to show that the earnings, were sufficiently large. Defendant's

solicitor then asked for-compensation in con sequence of bis client having been arrested * upon warrant and subjected to needless indignity. The warrant had been issued by the plnintiff (who swore he believed defendant intended leaving the colony) on the previous .day, and it was stated that Ternon had played hi* part last nieht under the eye of the Court bailiff. The B.M. agreed there had been no justification for the indiani y put upon Mr Vernon, ana granted him '£4 4a costs. HollOWay'S.
