The Goodison family, who made themselves so notorious a short ifme ago by selling to a Taieri farmer, when drunk, * horse for about £150/ hr.s been a^in H.. Court ; over a still more .peculiar; case.; Henry Goodison brought an action against the executors of Thos. Sutfan to recover altogether ,£llOO. The first action was upon, a, cheque alleged ,to be, T . signed by Sutton, who is now dead, for"----£658 ; the second for a bill alleged to be endorsed by Sutton for £500. ? The latter was withdrawn on the conclusion of the former. In the cheque case the considera* tion alleged was the sale of 84 head of eittle by plaintiff's brother, who had transferred the cheque to plaintiff, after attempting himself, several times to get it cashed, Sutton's backer refusing to admit that it was a, genuine signature. One peculiar element in the case was that Goodison had advertised the estate for sale after he had Sutton's cheque in his possession, and actually gave to the auctioneer an order to, pay the entire proceeds over to the person from whom he had bought the cattle on: bills—in this way, of coarse, ignoring any sale as alleged to Sutton. -~ The defence of Sutton's executors was that if the cheque was genn; ne ; Sufcfr) ton gave it when helplessly drunk, and the defending counsel hinted his opinion plainly that it was a forgery, and, indeed, he put it that the case actually reeked with fraud. The jury found that the cheque was obtained by .fraud whoa Sutton was deprived of the use ..of his reason by drink; that no consideration had been given, for it; and that nothing. was due to plaintiff. Counsel for "plaintiff give- notice to move for a new trial, <&< the ground that* there was, no evidence that Sutton was drunk. Sutton was a well-known farmer and sheep breeder.
