RESIDENT MAGISTRATE'S COURT

The charge of assault with intent pre* ferred against W. W. Gudgeon was called on for hearing. Mr Miller, who appeared for the prosecution, stated that Mr Tyler, of Auckland, who had been retained with him, and Mr Hesketh, who was to have appeared for the defence, had agreed to ask for an adjournment. He was prepared to go on with the case, but the defendant was anxious that if should be deferred. "
The Bench thought it was rather a novelty for parties to arrange an adjournment without consulting the convenience of the Court. It was disinclined to deprive
the defendant of the services of Mr Hesketh, but some other counsel would have to be obtained if that gentleman 3ould not attend. Fixtures had been made for every day for a fortnight, and ao the sittings of the Supreme Court was fixed for the 17th, the case could not be held over any lsnger than Saturday next.
The Court then adjourned.
