The case against Cornelius Ryan was dismissed, the bench having a doubt as to the wilful intention of the accused.
In the Appeal Court, judgment was given 'in the case of Bees v. Barker (Napier), discharging the rule for a new trial, each party to pay their own costs.
The case Crombie v. Fearce and others (Wellington), is now being heard at the Magistrate's Court.
The information against Gladman Smith, for alleged roil stuffing was withdrawn. A similar charge against ConEyan is proceeding.
