Sib, —The current report about town is that an informal or incorrect nomination paper was tendered to the Returning Officer oa Friday last, and ihat. the Returning Officer, instead of receiving it just as it was tendered him, and at 12 o'clock declaring it informal, exceeded or went altogether beyond his duty and powers by either correcting it himself or else pointing out to the candidate its informality and making him correct it, and then receiving it as a correct nomination paper. If such'is the case, I have no hesitation in saying that no matter how the result of the poll may place him, that candidate cannot sit, and his election must be upset on application before the KM. I rery much fear the illegal action of the [Returning Officer, although done with the best of motives, and without any intention on bis part to do wrong, will make void the entire election of all members for,that Riding of the County. The .Returning Officer has (unintentionally, I grant) done an act that has benefitted one candidate, and snch act must proportionately as it has benefitted one be detrimental to another. I suggest, as there is yet time, that a new day of nomination be appointed by the Governor for that Hiding, and by this means get over the difficulty.—-I am,<&c, •■ X Y.-Z.
