The Court assembled this morning, when Mr Hammond announced that the Court would adjourn till 12 o'clock, as the case was likely to be settled outside. The Court re-assembled at 12 o'clock, when Mr Mackay apologised to the Conrt for not complying with a summons issued by Mr,,§heehan to attend the Court and give evidence on behalf of the Crown against Mangakahia and party, yesterday. His reason was that he objected to giving evidence against his own clients. He would, however, apologise to the Court for doing so. The Court: You should have attended and given the evidence now given. .Mr Mackay admitted that he ought to have done so and said " I again offer my humble apology. Mr Sheeban iuformed the Court that since last evening an arrangement was come to between himself and Mangakahia, which was that the Crown agrees to cut off from those two blocks the Pokairhenua and Hiiihuitaka a thousand acres, for non-sellers and other objecting parties. Magakahai will arrange the details as far as his clients are concerned. The land can be taken in one or two blocks, as they think proper. On Monday he would ask the Court to make an order to that effect. Mangakahia intimated his consent, and Mr Sheehan baring thanked the Court for the concessions . granted to himself and Maugahahia, remarked that, after the settlement of the present case, on Monday he would take the Waiti and Kunanui blocks.
