Claim—That the Long Island Claim should be forfeited on the ground that the protection was obtained under lals& representation, and that the claim had not been properly worked for some considerable period.
Mr Miller appeared for the plaintiff". Samuel G-ribble said he was manager of the Lucks All Gr.M.Co. He had been manager for the company since Christmas. He knew the Long Island claim. The claim is partly on the company's license, and partly off it. Duriug the month of January there was about a day's work done on the Long Island Claim. He had often been into the drive, but found no work being done. About the 4th or sth of January defendant pointed out some work .he was going to do, but it had not been done yet.
Any ordinary man could have done the work performed in the drive by the defendant during the month of January in one day. William Brownet said he worked in the Luck's All claim for some months. He would have known if any work had been done in the drive. He had frequently seen defendant working in his garden. Charles Joy said he had a claim up the Waiotahi, and he had not seen any fresh work done in the claim spoken of. James Burns aaid that he had worked on and off. ytephenson left him some time before Christmas. He said there had been a lot of driving done. This case was adjourned until Thursday the 10th March to allow a survey of the claim to be made. Court adjourned.
