WARDEN'S COURT.
THIS DAY.
(Before H. Kenric-k, Esq., Warden.) DONNELLY AND OTHEES V. TONGE.
In this case Mr Cuff appeared for the plaintiff, and Mr Miller for the defence. Mr Miller asked under the 145 th section that the costs might be secured.
There appeared to be some difficulty in finding the security, aud the Warden adjourned the case until two o'clock. At two o'clock the case was proceeded with.
Patrick Donnelly deposed he had purchased the Crown Princess mine from the Warden and had repegged it out and worked it out with his mates He saw the defendant, Tonge, take some goods off the claim, and he told him not to do so as the property was his. He gave notice to the auctioneer not to sell the property, and placed notices to the same effect upon the ground.
Patrick Dillon gave similar evidence, and Mr R. R. McGregor in reference to the sale of the property.
