MITCHEIiL V. HATA PAKA.

His Worship said that this case had been adjourned for the purpose of inspecting a deed at Paeroa, the defendant having stated that he had given Mitchell his share in the Horo Horo block, and £4> cash in liquidation of the debi. He (the 8.M.) had inspected the deed, and found that defendant had sold his share in the* block nearly two years ago, so that he had set up a deliberate lie for a defence.

Order made that defendant pay £3 per month until the debt is liquidated and costs. ■

Mr Miller stated that defendant was still away at Te Aroha, but he had the witness Southgate present. .. *.; His Worship said that he would not like to make an order against the defen* dant, but would take Southgate's evidence and again adjourn the case. William Southgate, after apologising

for his inebriety on a former occasion, deposed to residing in Mr Adlam's store, and gave evidence regarding the contents of,the store—a few half chests of tsa, some flour, and sundries. He did not remember any potatoes going up to Te Aroha. The only things he saw Adlam taking up with him were an old bell tent, and a pick and shovel. • Adjourned till the 3rd proz. Court adjourned.
