RESIDENT MAGISTRATE'S COURT
THIS DAY. (Before H.Kenrick, Esq.,* 8.M.) CIVIL SIDE. POATA V. BOBEBT KELLY. Claim, £3 2s 3d, amount owing for gum. Mr Dodd for plaiatiff and Mr Miller for defendant.
A set off had been filed by the defendant, but His Worship said he could not accept it, as it was not legal, there being no dates mentioded. All witnesses ordered out of Court. Poata deposed—He sold sme gum to Mr Kelly on the 7th June, about 1| tons, worth £35 per ton. He had received £22 on account; He owed Mr Kelly £4 9s 5d for goods, and received the account for them on the 6th June. He was willing to pay Kelly out of the money owing to him tor the gum. The gum belonged to a number of natives, and each one's share was weighed separately, but it was sold in one lump. He represented the others in this action.
On the application of Mr Dodd the case was adjourned till to-morrow mornipg at ten o'clock, to allow Mr Miller time to full in the dates in the set-off.
