WARDEN'S COURT.

THIS DAY. (Before H. Kenrick, Esq., E.M.) MCLABBN T. DBNTEB.

This was an action brought by the Mining Inspector against H. Denyer for | catting timber other than kauri, not being a holder of a permit to do so. Mr Miller prosecuted. Mr Brassey defended. Mr McLaren was the first witness examined. He said he was in Court when the ciril case of Denyer v. Farrell was heard. He remembered Denyer saying, when speaking of other props besides the two the subject of the action, that he had cut them. The defendant stated to him that he cut them as firewood, but when the witness pointed out to him tbat props were not firewood, he said he was employed by the companies to cot them. Messrs Horsborough, Ferguson, and Mcllhaney also gave evidence. The defence set up was that the defendant was cutting aa a servant of the company. : For the defence the accused and Mr Eadford gave evidence. The Warden dismissed the case, saying that it appeared clear to him that under section 53 of the Goldfields Eegulations, owners of mines had perfect right to cut timber for mining purposes, and that the defendant was only employed by them to cut the timber. DENYEB T. FABBELL. Mr Brassey appeared for the complainant. Complaint laid by H. Denyer against Jno. Farrell to recover penalty prescribed by goldfield regulation for cutting one kauri tree without a license.

This case arose out of the evidence given by Farrell in the case Denyer v. Farrell in the B.M. Court on the 9th inst. , / The defendant pleaded guilty, and was fined 25s and costs of Court.
