RESIDENT MAGISTRATE'S COURT.

THIS DAY.

(Before Major Murray and J. Skene, Esq., J's.P.) ASSAULT IV CHUBCH.

Edward Noonan was charged with assaulting Thomas William Moroney, a little boy, while in Church on Sunday afternoon last.

Mr Miller appeared for the complainant and Mr Brassey for the defence.

Defendant pleaded " Not guilty." The complainant deposed that he was leaving the church after the service, and that before he reached the, door the defendant caught hold ot him, and "slung" him down several times, he also pushed him against the form and hurt his side. He was not unruly, and was leaving the church with other people. Cross-examined by Mr Brassey—-He knew that the boys were to be kept in, but he wanted to go as others were going He had once kicked a teacher on the shinß because he had struck him. He

did not pick up the stones with the intention of throwing them at Mr Noonan.

James Moroney corroborated. Michael Moroney admitted writing to Mr Noonan requesting an explanation of his conduct towards the boy.

Mr Brassey addressed the Court, and said he could prove that the assault had rot taken place, and could show that the boy waß most unruly. He would ask the if there were any case to defend P The Court decided to hear further evidence.

Mr Roche, the defendant, and another witness were called for the defence.

The Court decided that there was no case made out, and consequently dismissed it with costs. Court adjourned.
