The general question of law involved was, whether the mortgagees of an open gold mine, worked by tributers, may claim the gold won /or rent (acting in their capacity of landlord), or whether the gold s» obtained is severable from the land, and as the property of those who win it, not liable under the lien of the mortgagee.
