John Moon, sworn, deposed—l reside in Bella street. I remember the 23rd inst. On that date some boys made " hostile demonstrations " to me, one of them squaring his fists to me. I cannot say they said anything. It is very difficult to swear to overt acts, but they used hostile demonstration towards me. They have previously annoyed me.

Theophilus McCollum, sworn, deposed —I reside at Hape Creek. I saw some bo3 Ts standing near Mrs Percy's Hotel, and also saw Mr Moon. I did iot see any of the boys doing anything to Moon. I did not tell Constable Stapleton that the boys were insulting Moon. Elizabeth iPerey, sworn, deposed—l reside at Hape Jioad. On the day in question I saw a number of boys round Moon, and thinking that they were annoying him, I asked Moon to come into my house. I did not hear the boys say anything. Ellen Gould and Thomas McCollum gave corroborative evidence.

Iv defence, David Mackie stated that they did not throw clods at Moon nor insult him in any way, and the other defendants made like denials.

The Bench dismissed the case, saying there was not sufficient evidence to prove the case. Court adjourned.
