By a mistake a common jury had assembled, whereas a special jury had been applied for, and alter a good deal of legal argument, his Honor refused to try the case that day, and the record was withdrawn. Judge Johnston stigmatised the proceedings as a farce, And told the jury he was sorry he could not fix the blame precisely, or he would have made the defending side pay the jurors.
During, a violent thunderstorm at Ashburton on Saturdaj five horses belonging to a farmer named Sweeny at Sheffield were killed by lightning. They were seen together on Saturday evening in the paddock on the farm, but were found lying dead on Sunday morning. They bore no marks of violence, but the grass in their mouths indicated that their deaths must hare been instantaneous.
