AUCKLAND.

Supreme Court.

This day.

A Local Case.

Batcliffe, or Hunter, for making a false declaration of marriage, was arraigned this morning. Mr Brassey appeared for the prisoner and objected to the indictment as not setting out the Act under which the offence was constituted. The Marriage Acts of 1854 and 1858 were the only Acts set out on the face of the indictment, whereas it should have been under the Marriage Act of 1875, section 7.

The Judge upheld the objection, an" directed the Jury to return a verdict of acquittal. Prisoner was therefore acquitted.

No bill was returned in McGregor's) of Coromandel, case.
