At the Court of Appeal before the Chief Justice and Justice Richmond, White appellant, South British Insurance respondents. It appeared that White in 1865 took out a policy for £250 iv the South British, and while the policy was in full force the house was burnt down. The company repudiated the policy, on the ground of a violation of one of the conditions, which was to the effect that the amount would not be recoverable in the event of the property being subsequently insured in any other office without notice being given, so that they might have an opportunity of terminating their insurance if they wished. White sued the South British at Nelson for not less than £50, so an to give the Court juriadiction. It was proved by the defendants that other policies in another office to the amount of £450 in all had been taken oat by the plaintiff on the same property since the date of the South British policy. The Court gave judgment for the defendants, and White now appealed against this on the ground that the regulation of the Company as that referred to was uncalled for and unnecessary, and that £700— the amount insured—was not not above the value of the property. The Court decided against the appellant with costs.

James Hales, -was charged with voting twice at the late General Election, and was remanded.
