In the following case judgment was given for plaintiff with costs:—Price v. Lynch.—Claim, £8, goods, and costs 23a.

Mr Dodd for the defendant.

W. McDowell, sworn, deposed—l lately sold my hotel furniture to Mr Quint. Amongst the articles were some window curtains and bottles of sauce, etc., which have not been paid for. The arrangement was made by my wife and Mr Quint. Quint now refuses to pay for the articles. By Mr Dodd—l have not been told repeatedly to take the goods away by Mr and Mrs Quint. The price is a fair one for the goods. *

James Craig, sworn, deposed—l was called in to value some goods by Mr McDowell in the hotel now occupied by Mr Quint. I approved of the price McDowell had placed on the goods. No objection wns made to me about the amount of the valuation.

By Mr Dodd—Mr Quint and Mrs McDowell were to arrange about the articles in dispute. I afterwards saw the bill, and thought it was a fair one.

L. Melhjse, sworn, gave evidence con cerning the value of some of the articles.

This concluded the case for the plaintiff. Charles F. Quint, sworn, deposed—l am a licensed victualler. I lately bought Mr McDowell out of the Empire Hotel. I never purchased the goods mentioned in this bill of particulars, and the cause of this action. I have told plaintiff repeatedly to remove the goods. Plaintiff non-suited with costs.

SKODBEAS3 V. F. GABKATT. Claim, £17 15s, goods.

Mr Miller for plaintiff, and Mr Dodd for defendant.

Thomas Cashen, sworn, deposed—l am a settler at Ohinemuri. Some two years ago I took .a contract from the Koinata natives for fencing. Garraty and Carr were my partners. While working there we lived together, and we got our provisions from Snodgrass. The goods were got in Carr's name because Snodgrass honored his order. Some time after I went out of the contract, and went to work for Lipsey. Garraty and Carr carried on the contract, and it was stipulated that they should pay M. Power and Snodgrass. By Mr Dodd—Garraty and Carr were partners with me from the commencement.

By Mr Miller —I had a settling up with Garraty and Carr before leaving, and allowed for Snodgrass* account. They will get all the money for the contract. p. Snodgrass, the plaintiff, gave similar evidence. He held Carr and Garraty responsible. Mary Snodgrass, wife of the plaintiff, gave corroborative evidence. Francis Garraty, sworn, deposed—l am the defendant in this action. I know the previous witnesses, and have seen the bill of particulars. The goods were obtained on Carr's credit. I never authorised any one to pledge my credit to Snodgraii. I did not know anything about the case till last week. I don't owe the money.

By Mr Miller—l was not a partner in the contract. I was merely splitting rails at so much per hundred. I instructed t
