RESIDENT MAGISTRATE'S COURT

THIS DAY. (Before H. Kenriek, Esq., 8.M.) James Dare, a lad aged about 16, hi the employ of Mr Townsend, butaher, was charged with offensive conduct towards J. S. Hart.

Defendant, who was defended by Mr Miller, pleaded not guilty. J. £S. Hart, sworn, deposed. I reside in Pollen street. On the 25th iust. the defendant, whc was in the employ of Mr Townseud, butcher, behaved in a most provoking manner to both myself and my wi;'e. He made fsices across the fence, and niadu npise3 like a cat. This is only one instauce of series of annoyances to which I have been subjected by the lad. I have reasoned with him, and warned him td leavs me alone. *

By Mr Miller —The offensive action took place over the frnce dividing my yard from Mr Townsend's'. The fence is a close boarded one. I am not in the habit of watching Mr Townsend's yard. I did do it ouce, but gave up the custom. It is Jiot a fact that Mr Townsend and the boy had to stare rue out. The offensive sounds were addressed to me. Eliza Hart, wife of plaintiff, and a little boy, the son of Mr Hart, gave corroborative evidence.

I often make the noise.. Once Mr Hart told me to go about my business, and don't annoy him, but I did not know the uoise vexed Mr Hart.

Hurt, but iv this case ho would discharge him uith a caution. If ever ho appeared again charged with annoying Mr Hurt, he would hi* severe!}' punished. I Court adjourned.
