James Miller, cook aboard the schooner Sissy, was charged with being absent from duty this morning.
Defendant pleaded not guilty. He was going aboard when he was arrested.
Captain John lioss deposed that the defendant was on the articles of the schooner Sissy, being cook. He bad fiten defendant permission to go ashore to purchase some clothing, and he had not coiae aboard again in time to get the breakfast ready. He did not want to be hard bn'hittC aridl?M'^id'not^ink that the ;def<spdant would be any use to him after this he thought he had better take bis discharge. } Defendant 1 said Ke would flolthig."; ; .*' His Worsbip^ordered'the discharge to be made out, defendant to pay the costs.
