S i \XJ HEREAS by " Tho Municipal Corpora- j v * tions Act.,"lS7f>," it isenactrd thai the : Council of a borough constituted under thut j Act m»y tal<e or purchase under the provisions of "11)6 Public Works Act, 1876" (heveiriafter called " the said Act"), any lands within the borough required for tho good and efficient drainage of the borough : And whereas the Council of the Borough of Thames, requiring to take the land described in tho Schedule hereto for tho purpose of drainage, has laid before me the memorial referred to by section twenty-fivo of "The Public Works Act, 1876," praying mo to declare, by Proclamation, that euch land is token for such purpose:, '..'.■ And whereas the Mayor of the said borough has, in accordance with the twenty-eighth section of " The Public Worke Act 187.6 Amendment Act, 1878," laid before me a statutory declaration that*the Baid Council is authorized by law to undertake the work for irtffcli the land described in the memorial laid before me under section twenty-five of the said Act is required, that all the provisions of the said Act as to taking such land hare been complied with, ond that the said Council are of opinion that the proposed works should bo executed, and that no private injury will be done for which due compensation is not proTided, by.the jaid Act;: !/And .whereas; it .appears to me that all things required! by the ". Municipal Corporations Act,1876," "Tha Public Works Act, 1876," and "The Public Works Act 1876 Amendment Act, 1878," to be done and perr formed to. authorize the taking of such land Lave been done ay d performed, and it is expedient to declare that Buch laud is taken for the purpose aforesaid : Now, therefore, I, Sir Hercules George Boberfc Robinson, Governor of the Colony of New Zealand, by and with tho advice of the Executive Council 1 of the said colony, in exercise of the powers and authorities in me vested by the said Acts, and of any other power and I'authority enabling me in that behalf, do hereby proclaim and declare that the land described in the Schedule hereto is taken by the Council of the said borough for drainage upurpoßes .as; aforesaid ;' and that, from and after tho tenth day of May, one thousand eight hundred and se/enty-nine, the said land shall become Tested in ice-simple in the Mayor, Councillors, and Burgesses of the Borough of Thames for drainage purposes as. aforesaid. ... All those parcels of land, in the Provincial District of Auckland, in the Colony of New Zealand,; containing by admeasurement twenty-one' and nine-tenths (21;9) perches, more: ; or lees, situate in the Thames Survey District, and" being portions of Allotments numbered twenty-four (24), twenty-one (21), twenty > (20), nineteen (19), eighteen (18), Seventeen (17), twenty-six (26), twenty-seven (27), and thirty-eight (38), of a subdivision into allotments of a portion of the block called or known by the name of the Karaka Block, and numbered one thousand two hundred and forty-two A (1 242 a) . Portions of Allotments numbered twentyfour ,(24), twenty-one (21), twenty (20), nineteen (19), eighteen (18), seventeen (17), twenty-six. (26), and twenty-seven (27), containing sixteen and four-tenths (16-4) perches. Bounded, towards the North-east by Pollen &treei;'iwo (2) feet; towards the South-east by other'portions of Allotments numbered twenty-four (24), twenty-one (21), twenty (20), nineteen (19), eighteen (18), seventeen (17), ,and twenty-six (26), aforesaid, three hundred and thirty (330) feet; towards the South-west by Eyre Street, fifteen (15) feet; and towards the North-west by other portions of Allotments numbered twenty-seven (27), •eventeen (17), eighteen (1§), nineteen (19) twenty (20), twenty-one (21), arid twenty-four (24) aforesaid, and the Karaka Creek, three hundred and thirty-three (333) feet and bne (1) inch: be all the aforesaid measurements more or leas. Also all that portion of the Karaka Block included by the production in a south-westerly direction/ to the seaTvard boundary of said block, of !the lines which form the southeastern and north-western boundaries of that portion of Allotment numbered thirty-eight (38). above, described, andY containing by admeasurement two (2), perches, more or less.
