Cr Price said he supposed there was nothing for them but to pay it. [ (Jr Ehrenfried said it must be remembered that the Borough, which had an overdraft, was not ouly bearing its own burdens but also those of the County.., \ - By the direction of the Mayor' the! A letter was read from the Chief Siiriveyor: at Auckland re the Eecreation Ground survey. The Council had written to him asking for a refund of the expense the Borough had beehptit to through the incorrect plan suppliedthem. The. Chief Surveyor asked for proof of the incorrectness of the plan, and also for a.copy. of. the same. It was resolved to comply with the request; and also,that the Mayor be requested to see Mr Murdock and ask him for half of the cost of the suivey, uas it benefited him as much as it did the Borough. , . ■ j ; DAVY STBEET SOUTH. MlLlßft's ACCOUNT, The committee appointed re some items in Mj Miller's account reported that they had arranged ail matters satisfactorily, and recommended that the £5 ss, general retainer; be paid to him. If that amount was paid he could not appear pgainst the Council, except on behalf of the County Council, from whom he held a prior retainer. The report was adopted. :
TBEATY.OF WAJTANGI. '.' ' Mr J. A. Miller sent twenty-fire copies of the Treaty of Waitangi as a present to the Council. It was resolved to thank the donor for his gift. , ,r | ): BEPOBT OF COMMITTEE BE '* FOOD iAND E3UGS ACT." :■/': , i ! The report of this committee was read. It stated that the " Food and Drugs Act:" was in forco all through the colony, and Mr J. M. Tunny, of Auckland, Was analyst for this provincial district. The committee did not recommend the Council taking any action in the matter. The report was adopted. ' • : SCHOOIr CF MINES. - A telegram was read from Sir George Grey in reply to one from the Mayor asking that the promise to establish a School of Mines on the Thames should hot be overlooked. The Premier replied the matter would be at once considered in Cabinet. His Worship the Mayor said himself and the Borough'were under many'obligations to Sir George Grey, who had at aJI times taken the greatest interest in matters touching Borough interests. In the matter of telegrams the greatest promptness had been always shown by the Premier, and every matter referred to him had at once received attention, eon duty.
The gold duty committee reported that the gold returns had been examined for the months of February and March; and the amounts due to County and Borough fixed.
ANNUAL EEPOBT OF FOBEMAN OF WO3KB.
The annual report of the Foreman of Works, which had been ordered to lie on the table at last meeting, was received.

The report of the Works Committee was read as fol.nws :—
Your com in: tee have to report that the accident to Mr Grodkin's carriage on ♦he 4th of April was not the result cf any want of care on the part of the Council's workmen, nor wM any negligence shown by the Foreman of Works in repairing the culvert at which the accident occurred directly ho re* ceired information that the.top of the culrert had broken through. You committee do not therefore reoou.mend that the.damage to the carriage be made good, at the cost and charges of the Council. ' With regard' to the legs of the trestle work for carrying the largo race erected by the County Council in the centre of the Waiotahi Road, your committee met
tho Countj Engineer at that part of the road crossed by <heraCejli when the following proiposilida was submitted by Mr Aitken :—That the County Council form the road and metal it tor about three feet in widtli, on the side nearest the crtok, for a distance of about 20 yards on each side of th<? trestle leg, and that an undertaking be given by the County Council that they will remove entirely the centre trestle of tho three that are now placed upon tbe Waiotahi Creek road, between the creek ar.d the fence forming the inner boundary of the line of road, when called upon to do so by the Borough Council.
The report was adopted. HOSPITAL COMMTTTEB. Cr McGowan moved that Crs Brassey, Mennio and Price represent the Council ; on the Hospital Committee. Carried. FINANCE. ' ' ; The pay sheet and sundry accounts were passed for payment. : STKIAGHTENING KABAKA CHEEK. Mr E. McDonnell, fruiterer, appeared: and applied that his name be inserted on; the ro'l. He had been informed he was on defaulters list because he refused to' pay rates on property he was not liable
It was decided to put his name on the roll. !
The alterations, etc., were then initialled by the Mayor, and the roll signed by the: Mayor, Town Clerk, and two Councillors,! after which the meeting dispersed. '
