I paid £1 into Coort.in accordance with an agree* ment with Mr Miller, by which I was to pay £l per month. I was going to pay the ijther £1 when I received a letter from Sir Miller threatening to sue, so I paid the money to another creditor. Ordered to pay £1 per month. BABTT V. BLAIB. Claim, £3 Os 9d. A telegram had been received from defendant offering 5s per week. Ordered' to pay 5s per week. Defended Cases, loddbb v. hat. Claim, £10, damages for breach of eon- ' -MflJraßsey-for plaintiff, »nd Mr-Miller for defendant. Richard May, iworn, deposed—l am the'defendant. I recollect letting a fisbiag^boat to Lodder on the 21st, and >he took, possession on the 25th. Before letting it I had it repaired. It is a flatbottomed dingy worth £3 10s. I don't recollect speaking to Wilson,' asking him to hire me a boat to give to Lodder, as I had taken mine from him and feared to get into a mess about it. I lent Lodder • the boat for only one • week. I re-took possession of the boat on April Ist. Lodder had the boat for one week and a day. Mr Dodd paid me 3s on Lodder's account for the week and a day. I did not say I could take my own property when 1 liked. William Lodder, sworn, gave his version of the agreement, which was that he had the boat at a weekly rental of 2s 6d, and May, was to give him a week's notice when he; required the boat to go up the Piako. The agreement was made in the goods shed at Shortland wharf. Through the taking of the boat he had lost a net, having left it at Kopu. ' William Parker, sworn, gave corroborative evidence. He heard May asking "Wilson.to hire a boat to give to Lodder, as he knew there would be trouble over his taking away a boat from Lodder. Alfred Gubb and Henry Elvin, sworn, also gave corroborative evidence. Richard May, re-examined—l made the agreement with Lodder to let him have the boat for one week for 2s 6d. I only let him•,have it for charity. It is not necessary to give a week's notice when a boat it hired, unless particularly specified. .
