One individual was charged with this offence, but as it was his first offence, the Bench let him off with the mitigated fine of 5s and costs, or 12 hours' imprisonment. Samuel Thornally was charged with neglecting to walk at the head of his horse and cart while on the Burke street Wharf. i Defendant pleaded guilty, but said he j had just got on his cart as he was going j off the wharf, and he did not know he was doing wrong. . ' Mr Kenny said that the defendant was brought up as a warning to others, and a heavy penalty was not pressed for. Fined 5s and costs. THBEATENING LANGUAGE. William Jamieson was summoned to find sureties of the peace for using threatening language towards one William at Waikawau. B||f T)odd for complainant, and Mr .Miller for defendant. Mr Dodd stated the case.

James Bennett, sworn, deposed—-I am a bushman at Waikawau, and recollect last Monday. I went over to Edward Jamieson's because I had lost a pig, and I was told it was at Jamieson's. I saw Mrs Jamieson, and she showed me the pig, which was mine. When going home, j met defendant and he asked me where I had been. I told him, and he 'said I was a ■" d—*—d liar. The pig' was Tom's, and had been caught by him up Waikawau Creek." I was on hone- back; and he followed swearing at me, and said, "I'll sw^ig at. .Mdunt Eden for you yet." I gaVe 5 him no provocation, and never quarrelled with him before. I told him I did not want to have any row with him. His brothers then came up.

By Mr Miller —Some time before Jamieson told me that his dog had been on my sow—the mother of the pig in Jamieson's stye. I did not say to William Jamieson "I'll put you in Mount Eden again, you gaol bird." When he followed me he was talking all the time about pig stealing. I did not say anything. Tom tried to pull me off my horse and,struck me. Mr and Mrs McAlister were present at the time.

John McAlister, sworn, deposed—l am working at Waikawau, and recollect Monday last. I saw William Jamieson and complainant in front of my door. Jamieson threatened to beat Bennett if he would not say that I had said Jamieson had his pig. He was cursing and swearing at Bennett, and saying " I will punch your — head." Bennett did hot make use of any bad language. My wife was present, and Mr Mclntosh was inside. Defendant attempted to stop Bennett's horse.

By Mr Miller—The Jamiesons wanted to find out who informed. I hare had some bother with the Jamiesons about pigs. Margaret McAlister gave corroborative evidence.

This concluded the case.

Mr Miller submitted that there was no case to meet, as the language the defendant was accused of, viz., " I'll swing for you at Mount Eden yet," had not been proved. = His Worship overruled the objection. William Owen Jamieson, sworn, gave his version of the case, which was to the effecfc that Bennett had used insulting words to him. He (Jamieson) did not tell him that he would swing at Mount Eden for him yet; Case dismissed, without costs. ASSAULT. Thomas Jamieson was oharged with assaulting William Bennett at Waikawau on Monday last. The same counsel appeared in this case as in the last. Th« defendant pleaded guilty to pushing Bennett. Fined 20s and costs, or 3 days' im> prisonment. Court adjourned.
