No instrument of sale or transfer or any share or shares shall be valid, either at law or in equity, unless the name of the purchaser or transferee is inserted therein at the time of or before the exep o tion of the instru inent of sale or transfer, § . and, if. aay patten executes a lalenaote, transfer, contract-note, or other instrument of sale or transfer, in any manner, or for any purpose whatsoever, mi less the name of the purchaser is inserted therein at the time or before the.exeoutton thereof, he shall forfeit a sum of not lest than £20 or more than £100 1 and, if any such instrument is so made •reigned, it shall be wholly and absolutely void and inoperative, and shall in no cas» be made available by the insertion of a name or any other particulars afterwards; and the personsellingortqm#* ferring such share shall aot be divested of big interest therein, but,shall remain liable thereon as if he had never sold or disposed at the same.
