RESIDENT MAGISTRATE'S COURT
THIS DAY. (Before Colonel Fraser, R.M.) DRUNKENNESS. One individual was charged with this offence. He pleaded guilty, but said this was his first .offence, and he would go home to Te Aroha at once. Discharged. HOBSB STEALING. William Smith, a half caste, was charged with stealing from Komata one chestnut entire horse, of the value of £10, the property of one Peter Austin, on or about, the 22nd December. ; Prisoner pleaded not guilty. He said the horse had been given to him to break in. • '■■'■' •':■■'■•■ "' • Mr Miller appeared for the prosecutor. , His Worship said that the horse was claimed by Tinepoaka, Hunia and Tukukino, and it appeared that they had given it to the prisoner to break in. The evidence of the natives was as strong as that which Mr Austin could produce relative to the ownership of the horse, and' he would recommend the withdrawal of the charge, when Mr Austin might proceed civilly for the horse. ! ■ Charge withdrawn. | Court adjourned. . ,
