RESIDENT MAGISTRATE'S COURT

(Before W. Fraser, Esq., R.M.) ASSAULT.

George Dqdd, on warrant, was charged with assaulting Margaret Podd on the 2nd inst.

Defendant pleaded not guilty. There was no appearance of the complainant. His Worship said ho had seen the complainant yesterday, and she appeared to have been badly used. Defendant said that his wife had been drunk, and he was really not to blame. Mr Bullen asked for an adjournment till tomorrow, so that the police could make an investigation. Adjournment granted. ANOTHER CABE. Wm. H. Oldrey, on warrant, was charged with assaulting Jane Oldrey on the 2nd inst.

Mr Macdonald appeared for the defendant and pleaded not guilty. Mr Brassey appeared for the complainant, and stated the case. :

Jane Oldrey, sworn, deposed—l am the wife of defendant. I recollect Monday afternoon last. I had had ,an altercation with him at dinner tirhe, when he came in the worse of liquor,. and 1 accused him of drinking. He called me a bad name, and I left the table. Subsequently he said he would sell off the house and go to England. At four in the afternoon he came in and gave me a shove, and said, " What are you going to do, woman.'' He went out and Galled me names before my neighbors, and I went and caught him by the collar and pulled him into the house. He strug«led with me, and I threw him on the floor. I then went out into the yard, and he followed me, and threw a broom at me, and went inside. He was looking for an axe with which to chop me ddwn, and afterwards ran after me with a carving knife, when he was noticed by Mrs Smith. I went to Mr Quint's Hotel. I remained at the hotel for about an hour, and then went to his (Quint's) private house. On returning to the hotel,l was told that defendant wished to see me, and I went out with Mr Quint. We had some conversation, when defendant caught me by the throat. Mr Quint made him let me go. lam in fear of my life. He has threatened me with a knife before.

By Mr Macdonald—l knocked him down because he caught hold of me. He was drunk. He has repeated the same words when sober. He chased me with a knife. Charles F. Quint, sworn, deposed—On Monday last I was in my garden, and heard a row in Oldrey's, which adjoins my

place. My wife also heard the row and sent me on an errand so that I might not hear the row. One of defendant's children ran after me and said " Uncie, Papa's beating mamma." I returned and heard Oldrey abusing his wife and mine. Subsequently I was present when defendant seized his wife by the throat.

Mrs Oldrey, recalled, deposed that she was in fear for her life through Mr Oldrey's violence. She could not live with him. *

Mr Macdonald addressed the Court, pointing out that the defendant's ÜBing the knife meant nothing serious, as he had used it before.

His Worship bound defendant over to keep the peace for six months; himself in one surety of £100 and four other sureties of £50 each.

BOWDY BEHAYIOUB. -.: Two persons with a private grie/^ ance and impulsive temperaments were charged with behaving in such a manner in a public place to wit Burke street Thames on 30th ult, whereby a breach of the peace was occasioned. ""■"'}{.

Defendants pleaded guilty. One said that it was the first time he had done it in his life and he could not help it. " Fined 20s each and costs, or in default 3 days' imprisonment. DBUNKENNESS. Mow bray Meggett an old offender was charged with drunkenoes and incapability in Mary street on the 2nd inst. Defendant pleaded guilty and was fined 10s and costs, with the usual alternative. FBANSFEUS OF LICENSE. James McConnell applied for the transfer of the license of the Excelsior Hotel, Pollen street, to James McCannou. Mr Macdonald for applicant. Granted. Wm. Swindells applied for the transfer of the license of the Coach and Horses Hotel, Pollen street, to Michael Hay man. Granted. James Clark-applied for the transfer of the licenses of the Gity of Glasgow Hotel, Tararu, to H. J. McKee. Granted. Henry Gillett applied for the transfer of the license of the Nil Desperandum Hotel to E. J. Angove. Adjourned. Court adjourned. - " ' V
