Monday. , In the District Court to-clay Judge Bro d delivered judgment in the case of Tlrel, of Westport, against the Corporation of Nelson, 'j.he action was brought ■■> recover £2,5C0 damages ior injuries sustained through the alleged dangerous slate of the footpath. Two '^gal objections wee taken by the defendant, viz., tbat the Municipal Corporation Act casts no duty upon tneaa, and also that they had no vj'J'ce. Theje were overruled by tbe Gout, who (bund fo.' the Corporation, on the ground tbat tliere was nothing ur ascal oi 1 imp oper in iLe construction o" the paLh. e.iil lhat tie plaintiff might with reasonable c:vee have avoided the accident. The Judge said the case came witbin ihe principle staied by the Court of Common Pleas, ii Crouon v. the Me'Lopolitan hail way Company.
