A DIVORCE SUIT.
On April 13 the case of Menzies and Menzies, the petition""of a captain in the mercai! tile marine service, for dissolution of marriage by reason of his wife's misconduct, was heard before the President of the Probate and Divorce Division and a common jury. The petitioner at the time of his marriage was an officer on board the merchant ship Sobraon, trading between this country and the Indian Seas. The respondent, previously a Miss Mackenzie, and the petitioner were married at Dundee, Scotland, on August 20, 1870, and cohabited at various places, finally at Poplar, near London. As the petitioner, in following his calling, took long voyages, lie was necessarily absent from his wife for considerable periods, and during these periods he alleged that she had always received half his pay. In August, 1875, he had occasion to go to Brisbane, in Australia, and was absent for -twelve months. A child was born, and it was endeavored to be shown that the petitioner could not have been the father of it. The respondent was. also alleged to have become irregular, and dissolute in_ her habits, and by the dates of her husband's absence and the birth of the child it was sought to establish the charge of infidelity. Evidence of a premature confinement and other answers were, however, adduced, and the jury found for the respondent, whereupon the president dismissed the petition with costs.
