In the Supreme Court to-day, judgment was given in the case of Henderson v. the Queen. Tlie case, arose out of a contract at Westport The contractor tendered according to specification, but found that, as part of the section wa 8 through a swamp, there was great subsidence, which necessitated a very much greater quantity of earth filling than had been allowed for (about fire thousand pounds worth), hence the claim. Judgment was given for the Crown, with costs as agreed.
