RESIDENT MAGISTRATE'S COURT

Henry Dwyer, Maria Smith, and Alex. Phillips were charged with this offence. Dwyer and Phillips pleaded guilty, and were punished in the usual manner. Smith was on bail, and failing to appear her bail was forfeited. BREACH OF THE PEACE. James Kernahan, and Thomas Price were charged with a breach of the peace by fighting in Owen street, Grahamstown, on the 13th inst.

Price appeared and pleaded not guilty. Kernahan did not appear as he had been on bail.

Constable Haslett, sworn, deposed—l am stationed at Grahamstown. I was on duty yesterday morning at a quarter to 3 o'clock in Owen street. Price and Iternahan were abusing each other, when Price struck Kernsihan, and Kernahan struck him back, and they began to fight. I tried to separate them. Constable Baldwin gare corroborative evidence.

Defendant said that there were no blows struck. They had had a bit of an angry argument, but didn't fight. Fined 20s and costs. Kernahan's bail was forfeited. LABCENY. Frederick Mayo, on remand, was charged with stealing one bottle of brandy from the premises of John O'Halloran on the lab inst. Mr Macdonald appeared for the defendant, who pleaded guilty. Mr Macdonald said that he believed that his client was technically guilty, though not morally so. - . Mr Eullen stated that the defendant had been in the delirium tremens when he had taken the brandy bottle, and a friend of his had paid for it. Sentenced to 24 hours' imprisonment. THE PABAWAI TBEE-BBEAKING. William Jennings and James Clark, two youths, were charged with unlawfully and maliciously breaking one oak tree, the property of the Trustees of the Parawai District, of the value of Is sterling. The defendants pleaded guilty. Jennings said that they had been sky-larking round the tree, and it broke with then). Mr Hogg, one of the members of the Board, said that the tree was at least nine years old, and was eight inches in circumference, where it was broken. Sentenced to seven days' imprisonment with hard labor. Court adjourned. '
