RESIDENT MAGISTRATE'S COURT
THIS DAY.
(Before H. C. Goldsmith and A. J. Allom, Esqs., J's.P.) PEBMITTINO A NUISANCE. Bobert Easter was charged with a breach of section 33, By-law No. 3, Borough of Thames, by unlawfully suffering impure matter to remain upon his premises in Eolleston street, Thames, as to be offensive. Defendant pleaded guilty. . Mr Bullen said that the constable on duty bad smelt a most sickening smell while passing the defendant's bouse, and on going to the back found two tubs in which was decaying meat and liquid matter, which emitted a fearful stench. Defendant said that there was no meat in the tubs. Thero was only vegetables. Constable Scott, sworn, deposed—l know where the defendant resides. I was on duty in Bolleston street on Sunday week last. I.smelt a most sickening iniell while passing the defendant's bouse, and went round to the rear, and saw a woman standing beside two tubs in which were sheep's entrails, lights and livers, which smelt very bad. The woman said she was going to feed the pigs. Fined 10si and costs. JS> . ASSAULT. William Barnett was charged with unlawfully assaulting and beating one Frederick: Bryant on the 24th ultimo. The defendant was called, but did not Mr Bullen said that the summons had been served at defendant's residence on the 3rd (January, but it appeared; that be had left fo? Auckland on the 28th ultimo. Mr Dodd. applied for an adjournment till the Stli, saying that if the defendant did not appear he would apply for a warrant to issue for bis apprehension, as the assault had been of a most aggravated character.
