THIS DAY. (Before Jackson Keddell, Esq., E.M.) * DBUNKTSNNES9. . John Moon was charged with Laving been drunk and incapable in Brown street, Grabamstown on the 18th inst. Defendant pleaded not guilty. Constable Haslett, sworn, deposed—l . was on duty in Grahamstown last night. I apprehended defendant, who was very drunk, and put him in the lock-up. He was quite incapable. Constable Page, sworn, deposed—l saw defendant when being taken to the lock-up last night charged with being drunk and incapable. < In my opinion he was drunk. Defendant denied having been drunk and incapable. He said ho had been aeven and ahalf years on the Thames, and bad-always conducted himself with "- propriety. . A fortnight ago he had been charged witK the same offence, but his case hod. been settled a minute or two before he got id the Court (he was then out on bail). On that occasion, defendant said, he,had two witnesses who would have, testified to bis innocence. Last evening he"had met a friend who insisted on " shiouting/Vfor him. and he confessed he might have taken a little too much, but 4jf*was not incapable. • His Worship said two constables having sworn to defendant's insobriety when arrested, he believed defendant was mistaken as to his state, and it would have been better for him had he pleaded guilty, as thoV,expenSe would then have been less." ."''':'.'
