In this case the plaint,set forth that the defendants being the registered owners of a claim situated at Tararu kno.wn.and registered as the John Bull claim had failed, to bona fide and continuously, work the said claim from day to day by the number of men prescribed in the regulation in respect of said claim.to wit, by one man for &»ery 15,000 square feet, wherefore the plaintiff prays that the said claim be forfeited and an order to take possession be granted to him. "Charles Jenkins, sworn, deposed~l am a miner residing at Tararu and hold a miner's right No. 2179 dated 10th May 1876. I know the John Bull claim at Tararu. It has not been worked for some time, and I wish to get .aa order of forfeiture for non working..-'.'",' Frederick Burgess,., sworn, deposed—l am a clerk in the Warden's Court, and in. absence of the Mining Registrar I produce the register ~of' the John 'Bull ground, containing""six men's ground and belonging to the defendants in this action.
