J. 0. Akers was charged with unlawfully leaving a cart unattended on Beach road,* Thames, without first passing a chain through the wheel of the said cart ,80. as to effectually stop the rotation of .the.said wheel, on the 3rd instant. . .Defendant-pleaded not guilty. Mr Bullen stated the case. ; Sergt.-.'MulviKe, sworn, deposed—l am stationed at Grahamstown. In consequence of information received I saw Mr -Akers, and he said that he had taken "out the leader and took him to tie him up. The shaft horse then took fright and ran down tbe wharf. He had done all he could to catch the horse. He said.that he had not used a chain as it was not usual to dp, so. ■ John JSTicholls, sworn, deposed—l am a: carter residing in the Borough of Thames. Xrecollect being on the Goods, Wharf on. the,3rdinst. I saw a horse and dray coming down the wharf as hard as they could go. There were several other Tehicles on the wharf The horse ran into my cart. I thought it better to hurt the cart than kill the horse, so I put my cart,across the wharf. Mr Akers was the OWB#L. Defendant said he was tying up his leader to the tie-rail when the shatter took fright and bolted down the wharf.' He had hardly unhooked the horse, and he did not leave his cart when the horse ran away. The heavy carts did not have chains. ,; • " . i^JFined 2s 6d and costs. ..- "» * PBGFANE LANGUAGE. " Mary ".-Winepress and Mary Spears were charged with unlawfully using profane~ language in a public place to wit Kirkwood' street, Thames, within the hearing of persons passing therein, on the 3rd'iDst.

Mr Dodd said that if the word was inserted it would make two charges. I recollect the evening of Saturday Jast. I know the two defendants now before the Courfc Mrs Winepress -resides in Queen street irnd the other in Kirk wood street/ Isaw them in Kirk wood street on the. evening in question. Mrs Winepress came out of Mrs Spears? house, and^Mrs Spears called -the other a ——-. (Witness detailed the language used which is unfit for publicaliott.) i I heard Mrs Winepress call her a whore once, but she did not swear or use? jjrofene language. /. She said she supposed they would both get into it -when they came before the Court, i Sergt. Mulville, sworn,-deposed—l am stationed at Grahamstown. I know the defendantsr, and have known them for several -montlis.'l I was in Kirkwpbd street on Saturday evening. The defen- ! dants were' calling each other names. By Mr JBrassey—l was nearly opposite Mr Winepress' house. . They wore swearat one another. They were both using the bad langunge. . Mrs Winepress was using the name of the Deity. I went to the scene of the disturbance, and their men pulled them into their houses. I had no occasion to interfere. •" By Mr Dodd —It was at the back of Mr Spears' house. M"r Brassey addressed the^tiourt pointing out that there was no evidence against Mrs Winepress. He could call several witnesses for the defence. Bichard Bentrys, sworn, deposed—l reside in Queen street. I recollect the evening of the 3rd of March. I was standing near' Mrs Winepress' door, when I heard my name mentioned with a lot of bad-language after it in Mrs Spears' house. I went over and remonstrated with Mrs Spears, and.she flew at me and Vegan usiDg the most frightful language. She then pitched into Mrs Winepress and used bad language to.her. Ilive with Mrs. Winepress and take care of the children. ■
Elizabeth Gash, sworn, deposed—l recollect the evening of Saturday last. I saw Mrs • Winepress come out of Mrs Spears;■door, and heard Mrs "Winepress say .that, she was jealous,-and then. Mrs Spears began'tp use bad language. Mrs Winepress did not use much bad language. I was on the opposite side of the street. lam friendly with Mrs Spears. We are not bad-friends.:
Mr Dodd then addressed the Court and Jfcsaid he had 'ho evidence to offer for the defence of his client. . . -
In answer to the Bench Mr Bullen said that there were four convictions against Mrs Spears. ..." Fined~4os and costs each, or in default ' 14 days' imprisonment. Court adjourned.
