A sitting of the Court of Appeal was held this morning before the Chief Justice ,and Justice Johnston. In the case " Eegina v. Woodgate," Dr Foster* and Mr^ltogers appeared for the prisoner, who was convicted at Nelson for the murder of his illegitimate child in , a lonely part of Queen Charlotte Sound. The points raised by his counsel were.: First, that the child had not been born ; and, second, that there was not sufficient corroborative testimony to enable the case to go to the jury on the prisoner's own admission of guilt The case was argued at considerable length by Dr Foster, who quoted a large number of authorities on. the subject. Ultimately the conviction by the jury was affirmed. The only other case before the Court was that of S. H. Knibbs, convicted last session here of stealing a letter from a private box at the Post Office. The point raised by the counsel was that the letter, on being placed in the letter box, ceased to be vested inifthe Postmaster, who was the prosecutor.
