THIS DAY. (Before His Honor F. D. Fjenton, Esq., ... „,..,. ..Judge.) . -„.• MACDONALD AND MILLER V. WILLIAM PAYNE AND OTHERS. This was an action to recover the sum of £61 for professional services. Mr Tyler for the. plaintiffs ; defendants were undefended, and did not appear. Mr Mason proved the service of the summonses on the several defendants, with the dates on which the summonses were served. Mr J. A. Miller proved the debt in the usual manner. Judgement for plaintiiis, with costs £6 10s.

Sittings in Bankruptcy, messes tooket and webb. Mr Tyler who appeared for the bankrupts applied to have the case adjourned until December 7th owing to the absence of Mr- Macdonald, .who was retainedJby the trustee. " ■■■■<- -■-■■* w-' ■-:■ Adjourned until December 7th.

BENNETT V. CASSIN. His Honor gave bis judgment regarding the costs in this case a question which he had reserved since the last sitting of .the Court. Mr Tyler for Cassin reminded His Honor that there had been two trials and that the defendant had succeeded in the second trial. His Honor gave judgment that costs should be payed by the plaintiff, since the money (£10) had been paid into Court. These amounted to £5 10s in the first case and £8 14s in the second. The Court then rose.
